| Descrizione sintetica in italiano | The research project shall be structured as follows. In a first phase (6 months), the research activity shall be focused on the collection of the relevant material concerning legal sources and contractual tools in this field, with special reference to current national and international best practices. In a second phase (6 months), the research activity shall elaborate on the information collected in the first phase in order to propose the actual best practices for the management of plant variety rights by the University as innovative breeder; in this phase the activity shall be carried out in collaboration with the Knowledge Transfer Office (KTO), which is in charge for the management of University of Bologna’s intellectual property. In a third phase (6 months), the research activity shall formalize guidelines by means of report and other publications concerning the management of plant variety rights within the academic context. |
| Descrizione sintetica in inglese | The sector of plant varieties is growing nationally and internationally, being the market for agricultural products and foodstuffs more and more interested in quality and innovation. The University of Bologna is very active in this research field, having developed many new plant varieties especially of fruit trees. In this perspective, the legal protection conferred to the breeder has a fundamental importance, according to the typical mechanism of intellectual property as incentive to innovate by means of exclusive rights limited in time. However, the special regime of plant variety rights presents complex peculiarities, also because of the inherent characters of plants as living material subject to protection. Such issues become even more complicated as this intellectual property title is inserted within the academic context, where the public mission of the University has to be combined with all the problematic aspects that already affect the dynamics of creation and exploitation. |
