| Descrizione sintetica in italiano | L’oggetto della ricerca riguarda le categorie delle res romane, anche nelle loro connessioni con problemi posti dalla realtà di oggi. Il candidato studierà le tassonomie emerse nella riflessione dei giureconsulti (ad es. le res communes omnium e le res extra commercium), conducendo il proprio studio sulle fonti romane – quali il Corpus Iuris e le fonti letterarie –, verificando altresì, se opportuno, la loro genuinità e la presenza di eventuali alterazioni. In questo contesto, andranno indagati i profili sostanziali e rimediali che i prudentes riconducevano alle singole categorie, con attenzione ai problemi posti dalla titolarità e dall’uso delle diverse specie di res, nonché alla loro circolazione (ad es. tramite mancipatio o fiducia). Inoltre, nel corso della ricerca, sarà opportuno valutare questi problemi anche alla luce dei loro riflessi sulle categorie attuali |
| Descrizione sintetica in inglese | The research concerns the categories of the Roman res, also in their connections with problems posed by today’s reality. The candidate will study the taxonomies that emerged in the jurists’ reflections (e.g. res communes omnium and res extra commercium), conducting his or her own study of Roman sources – such as Corpus Iuris and literary texts – also, when necessary, by checking their authenticity and verifying the presence of any alterations. In this context, it is required that the investigator looks into the substantive and procedural profiles that the prudentes connected to the individual categories, with peculiar attention to the problems posed by the ownership and use of the various res species, as well as by their circulation (e.g. through mancipatio or fiducia). Furthermore, in the course of the research, these problems should be assessed in the light of their impact on current categories |
