| Descrizione sintetica in italiano | The research project purports to answer the question of what the constitutional limitations to withdraw from the EU are. Both substantial and procedural issues will be analyzed, comparing the different foreseeable options in the various Member States. The Brexit process has fostered not only political and societal turmoil, but also an intense legal debate. At the EU level, it has forced the Court of Justice to clarify the meaning of article 50 TEU in the widely commented Wightman judgment. In the UK, the discussion has been even harsher. In fact, article 50 TEU requires the withdrawing State to trigger the process abiding by its own internal constitutional rules: Brexit exposed how very unclear these may be. As a matter of fact, it took two decisions by the UK Supreme Court (Miller I and II) to settle the issue. The question inevitably follows: how would other Member States trigger article 50 TEU, were they willing to do it? |
